The Privacy Policy lets you know how we collect, use, share, and protect information about you when you interact with Pinpoint Software and its affiliates – Date Check Pro, Date Check Pro For Healthcare, and Taskle – through our website, however accessed, (“Website”) or mobile applications (“App”) (which we will refer to together as the “Site”) to use or obtain any of our products or services (the “Services”). Where we post this Privacy Policy, we explain what information we collect through the Site, how we use it, with whom we share it, and the choices you have to control, access, and update your information. The Privacy Policy also sets forth our privacy practices with respect to any Apps made available to you by us or our affiliates. By using our Services you agree to the privacy practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please uninstall any Apps from your device and stop using the Services. By continuing to use the Services, you accept this Privacy Policy.

WHEN WE PROVIDE THE APP AND WEBSITE FOR A THIRD PARTY

Certain Apps and portions of the Website are provided to you on behalf of our third-party clients (“Client”) who may be your employer or with whom you may have a business relationship. The collection, use, and sharing practices of the information we collect from the App or the applicable portions of the Website on behalf of those Clients are governed by those Client’s Privacy Policies.

HOW WE SHARE YOUR INFORMATION

    • We share information about you with service providers to perform functions and process your data and to help provide our Services including hosting and storage providers, payment processors etc.
    • With our third party Clients where we are providing the App or portions of the Website to you on their behalf

LINKS TO OTHER WEB SITES AND SERVICES

We are not responsible for the practices employed by websites or services linked to or from the app, including the information or content contained in such websites or services, and this policy does not apply to them. Your browsing and interaction on any third-party website or service, including those that have a link on our Site, are subject to that third party’s own rules and privacy policies. Please read the terms of such websites carefully and exercise care when providing your personally identifiable information.

Social Media Features: Our Services include links to social media features, such as links to our Facebook page. These features may collect your IP address, which page you are visiting while using our Services, and any Facebook cookies on your device (including your Facebook ID). These services may set cookies to enable the feature to function properly. Please note that the social media services may collect this information even if you are not logged in to the relevant social media account when you are using the Services. BROWSER DO NOT TRACK

Our Site does not support Do Not Track (DNT) at this time. Pinpoint Software as Controller

Pinpoint Software obtains and processes personal information in different capacities. When you provide us with your information through our Site so that we can provide you our Services, we serve as a data controller. When we act as a data controller we determine how personal information will be utilized, in accordance with this Privacy Policy. When we process personal information provided about you by our third party Clients or that you provide to us when we are acting or providing services on behalf of our Clients, we are a data processor, and we only process personal information on behalf and on the instruction of our Clients, who are data controllers. Our Clients are responsible for providing the relevant individuals with the necessary information with respect to the use of the individuals’ personal information and gaining all necessary permissions. We are not responsible for our Clients’ processing and use of your information.

Our Legal Basis for Processing Your Personal Data

We process the personal information you provide relating to the Services and Site in order to perform our contractual obligations to provide you Services. We also process your personal information based on our legitimate interests to provide our Services and Site to you, to develop and improve our Services and Site that we provide to you, to prevent fraud, and/or comply with law enforcement requests. Erasure of Personal Data

You have the right to delete the data collected through our Site and can do so by logging into your account and either deleting your account or deleting the specific personal data. How Long We Keep Your Personal Data

We retain your personal data for as long as necessary to provide the Services and Site to you. We will retain and use this information as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and then delete it.

INTERNATIONAL TRANSFER OF INFORMATION COLLECTED

Information Pinpoint Software collects from you will be stored and processed in the United States. If you provide us information, it will be transferred to, processed, and accessed in the United States. This Privacy Policy shall apply even if we transfer Personal Data from non-United States countries to other countries.

YOU CONSENT TO ANY AND ALL INFORMATION YOU PROVIDE AND SUBMIT VIA THE SITE BEING SENT TO THE UNITED STATES OF AMERICA. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. PINPOINT SOFTWARE relies on derogations for specific situations as set forth in Article 49 of the GDPR. YOU ARE ALSO INFORMED THAT THE UNITED STATES PRESENTLY DOES NOT HAVE AN ADEQUATE LEVEL OF PERSONAL DATA PROTECTION AS DETERMINED BY THE EUROPEAN COMMISSION’S ADEQUACY DECISION ON OCTOBER 6, 2015 (Case C-362/14) AND ARTICULATED IN THE EUROPEAN UNION’S GENERAL DATA PROTECTION REGULATION AND HAS NOT RECEIVED A SIMILAR DESIGNATION OF ADEQUACY BY ANY OTHER FOREIGN DATA PROTECTION AUTHORITY.
